Agent Service Agreement

This Agent Service Agreement ("Agreement") governs the use of the Homenet Australia platform ("Platform") by licensed real estate agents and agencies ("Agent", "you"). By registering an agent or agency account, you agree to the terms of this Agreement in addition to the general Terms of Service and Privacy Policy.
1. Platform Access — Free of Charge
Access to the Homenet Australia Platform is provided at no cost to licensed real estate agents and agencies. There are no subscription fees, listing fees, or lead-generation charges. We reserve the right to introduce optional paid promotional features in the future, which will always be clearly disclosed and strictly opt-in.
2. Licence Requirements
To use agent features (creating and publishing listings, accepting enquiries, registering inspections), you must hold a current ACT Real Estate Agent licence issued by Access Canberra or be employed by a licensed agency. You must:
- Provide your valid licence number during registration;
- Update your licence expiry date on your Homenet profile within 7 days of renewal;
- Cease publishing listings immediately if your licence lapses.
Homenet Australia sends automated reminders at 60 days and 14 days before licence expiry. Upon expiry, agent listings will be automatically restricted (contact details hidden, new applications disabled) until a renewed licence expiry date is provided.
3. Listing Standards
You represent and warrant that all listings you publish on the Platform:
- Are properties for which you hold a valid agency authority signed by the vendor or landlord;
- Contain accurate, current, and non-misleading information including price, address, and property details;
- Comply with the Agents Act 2003 (ACT), the Residential Tenancies Act 1997 (ACT), and the Australian Consumer Law;
- Do not infringe the intellectual property rights of any third party.
4. Photography and Media
You must have the rights to all images, floor plans, videos, and 3D tours uploaded to your listings. If you use a third-party photographer, you must have a written licence from the photographer permitting online display. Homenet Australia may remove content that is subject to a valid copyright complaint.
5. Agency Accounts
An agency account may be registered by a licensee-in-charge or authorised principal of the agency. The agency account holder is responsible for:
- Ensuring all agents added to the agency account hold valid ACT licences;
- Revoking access for agents who leave the agency or whose licences lapse;
- The conduct of all agents operating under the agency account.
New agency registrations are subject to a brief review by Homenet Australia administrators before activation, typically completed within 2 business days.
6. Enquiry Handling and Tenant Applications
Enquiries and rental applications submitted through the Platform are routed to the listed agent's registered email address. You agree to respond to genuine enquiries within a reasonable time. Homenet Australia is not a party to any tenancy agreement, sale contract, or other transaction facilitated through the Platform.
7. Fair Use and Platform Integrity
You must not:
- Create duplicate or "dummy" listings to game search rankings;
- Use automated tools to bulk-upload or modify listings without prior written consent;
- Harvest contact details of enquirers for purposes other than responding to their specific enquiry;
- Post listings on behalf of unlicensed individuals.
8. Termination
Homenet Australia may suspend or terminate your access at any time if you breach this Agreement, your licence expires and is not renewed within 30 days, or your agency registration is revoked. You may close your account at any time by contacting support@homenet.com.au. On termination, your listings will be unpublished and your personal data handled per our Privacy Policy.
9. Indemnity
You indemnify Homenet Australia against all claims, losses, and costs arising from your breach of this Agreement, inaccurate listing information, or infringement of third-party intellectual property.
10. Dispute Resolution
In the event of a dispute arising under this Agreement, both parties agree to attempt resolution through good-faith negotiation before resorting to litigation. This Agreement is governed by the laws of the Australian Capital Territory.
11. Amendments
Homenet Australia may amend this Agreement with 14 days' notice. Continued use of the Platform after the effective date constitutes acceptance of the amended Agreement. If you do not accept amendments, you should close your account before the effective date.
